Terms of Service

These Terms of Service govern your access to and use of the Homecraft platform. By creating an account or using the Platform, you agree to be bound by these Terms.
1. Definitions
“Platform” — the Homecraft website through which the relevant services are offered.
“Service”/“Work” — the service that a Service Provider renders for the benefit of a Client within an Order, including in accordance with the agreement between them.
“Client” — a user of the Platform who is looking for a service offered through the Platform.
“Service Provider” — a natural or legal person who offers the relevant service to a Client through the Platform.
“User” — a Client and/or a Service Provider.
“Order” — an agreement between a Client and a Service Provider for the provision of a service.
“Milestone” — a defined stage of the Work within an Order.
“Escrow” — the system in which payments made within a Client's Order are held until the Work is approved.
2. Role and responsibility of the Platform
Homecraft is an online marketplace that connects Clients and Service Providers.
The Client and the Service Provider understand and agree that the terms of the service are determined exclusively by the agreement concluded between them. Homecraft is not a party to the agreement concluded between the Client and the Service Provider, does not interfere with its content, does not control it, and/or does not give any guarantee in relation to the agreement concluded between them; accordingly, it is not liable for the performance of obligations on the part of the Client or the Service Provider.
Any matter related to the service rendered, including disputes arising between the parties, is considered and resolved directly between the parties.
Homecraft does not determine, change, or supervise the terms of the agreement concluded between the Client and the Service Provider (including but not limited to the content of the Work, the amount of remuneration, deadlines, and/or other material terms).
Service Providers are independent third parties from Homecraft. Homecraft does not enter into a contractual relationship with Service Providers on behalf of the Client and does not participate in the process of rendering the service, does not supervise, manage, and/or control them.
Homecraft gives no guarantee as to: (a) the quality, safety, legality, or timeliness of the Work performed; (b) the qualification, licensing, insurance, or certification of the Service Provider; (c) the accuracy of portfolio, profile, or project information; (d) the outcome of the project.
Homecraft is not liable for damage caused to the Service Provider or to the performer of the service that arises from or is in any way connected with the services rendered or provided by Service Providers and/or the breach of an obligation on the part of the Client.
This limitation applies regardless of the legal basis of the claim (contract, tort, including negligence, or another basis).
By agreeing to these terms and conditions, you acknowledge that hiring a Service Provider through Homecraft is done at your own risk. Homecraft will not be liable for property damage, personal injury, project delay, cost overrun, and/or any other loss arising from the service.
3. User accounts
When creating an account, you must provide the Platform with accurate/correct information.
You are responsible for the security of your account credentials.
Service Provider legal entities must submit a 9-digit identification code, and natural persons an 11-digit personal number.
Each Service Provider account requires verification before activation.
4. Client
The Client expressly acknowledges, agrees, and confirms that:
(1) Homecraft is not a party to the legal relationship existing between the Client and the Service Provider, including but not limited to the fact that Homecraft does not participate in determining the material terms of the service, in selecting the Service Provider, in concluding the contract, in performing and/or accepting the service, or in the process of approving/accepting the work result;
(2) Homecraft does not supervise, manage, and/or control the process and/or result of the service rendered by the Service Provider;
(3) Homecraft assumes no liability whatsoever in relation to the quality, safety, and/or legality of the service rendered or the product created by the Service Provider;
(4) Homecraft does not determine the Service Provider's work schedule and/or the place of performance of the Work;
(5) Homecraft does not provide the Service Provider with any type of resource or infrastructure (equipment, tools, materials, or other resources) required to perform the service;
(6) any dispute arising between the Client and the Service Provider must be resolved solely between those parties; Homecraft bears no responsibility for this;
(7) Homecraft is not the employer of the Service Provider;
(8) the Service Provider, as an independent contractor, has the right, at its own expense, to hire employees and/or engage subcontractors in performing the service, unless otherwise agreed between the Client and the Service Provider;
(9) Homecraft gives no guarantee as to the correctness and/or accuracy of the information posted by Service Providers on the Platform, their ability to deliver the service, and/or the performance of their obligations.
5. Service Provider
The Service Provider expressly acknowledges, agrees, and confirms that:
(1) Homecraft is not a party to the legal relationship existing between the Client and the Service Provider, including but not limited to the fact that Homecraft does not participate in determining the material terms of the service, in selecting the Client, in concluding the contract, in performing and/or accepting the service, or in the process of approving/accepting the work result;
(2) Homecraft does not supervise, manage, and/or control the process and/or result of the service rendered by the Service Provider;
(3) Homecraft assumes no liability whatsoever in relation to the quality, safety, and/or legality of the service rendered or the product created by the Service Provider;
(4) Homecraft does not determine and/or supervise the terms of the Work offered by the Client (including remuneration and/or related details, deadlines, and/or other material terms);
(5) Homecraft does not provide the Service Provider with any type of resource or infrastructure (equipment, tools, materials, or other resources) required to perform the service;
(6) any dispute arising between the Client and the Service Provider must be resolved solely between those parties; Homecraft bears no responsibility for such a dispute;
(7) Homecraft is not the employer of the Service Provider;
(8) the Service Provider, as an independent contractor, has the right, at its own expense, to hire employees and/or engage subcontractors in performing the service, unless otherwise agreed between the Client and the Service Provider;
(9) Homecraft gives no guarantee as to the correctness and/or accuracy of the information posted by Service Providers on the Platform, their ability to deliver the service, and/or the performance of their obligations.
6. Obligations of the Service Provider
You must provide the Platform and the Client with accurate, valid, and non-misleading portfolio information, certificates, and other profile details.
You are obliged to obtain all licences, permits, and/or authorisations required by Georgian legislation to render the service.
You must perform the agreed Work in good faith, properly, and in accordance with prevailing market standards and the agreed terms.
You are responsible for fulfilling your tax obligations.
7. Obligations of the Client
You are obliged, before hiring a Service Provider, to diligently check them, including the certificates, reviews, and licences they present.
You are responsible for providing the Service Provider with the project specifications and clear requirements.
You must thoroughly review all Work before approving any Milestone. We strongly recommend an on-site physical inspection of the Work before confirming it.
You must rate the Service Provider in good faith, based on your real experience.
You must bear in mind that the ratings and reviews of Service Providers on the Platform derive from the subjective opinions of other users and should not be the sole basis for a hiring decision.
8. Orders and Milestones
Orders are created by Service Providers and the Client accepts/confirms them.
Each Order posted on Homecraft may include one or more Milestones, which reflect distinct stages of performance of the Work, deadlines, and the corresponding remuneration.
Each Milestone may carry the following statuses: (a) “Pending”; (b) “In progress”; (c) “Submitted”; (d) “Approved”; (e) “Paid”. A change of status reflects the progress of the Work and the performance of the corresponding obligations by the parties.
The Service Provider is obliged to perform the Work in accordance with the terms agreed in advance with the Client and, upon completion of each Milestone, to submit the corresponding Work (the “Submitted” status). The Client is obliged to assess the received Work within a reasonable time and, if the result is satisfactory, to approve it (the “Approved” status), or to present substantiated remarks and requests for correction of the performed Work.
After the Client confirms the Work, the corresponding Milestone is deemed completed and becomes subject to payment (the “Paid” status), in accordance with the applicable payment terms.
The Client is obliged, before the agreement, to carefully review all material terms, including the scope of the Work, deadlines, the structure of the Milestones, the amount of remuneration, and the payment terms. Accepting the Order means the Client's full and unconditional agreement to those terms.
The parties agree that any communication, change, or addition related to the Order must take place within the Platform and be confirmed bilaterally.
9. Escrow and payment terms
9.1 Escrow Services
Escrow services include receiving, holding, and transferring project-related funds, as well as paying the corresponding fee to the Platform.
9.2 Escrow Instructions
Homecraft (also referred to as the Escrow Agent) acts in accordance with the escrow instructions specified in this agreement and disposes of the funds solely on the basis of these terms.
The parties confirm that: the Escrow Agent acts only as a neutral intermediary between the Client and the Service Provider; the Escrow Agent, except in the cases directly defined by this agreement, assumes no additional obligations; the escrow service is deemed fully rendered if it has been performed in accordance with this agreement and the relevant instructions.
Release (disbursement) of funds occurs only: in accordance with this agreement and the relevant instructions; or as required by applicable legislation.
The Client's payment obligation arises immediately upon approval of the Milestone. By approving a Milestone, the Client represents and warrants that it has thoroughly checked the Work and is satisfied with what was delivered.
Approval of a Milestone is final and irreversible. After approval, the payment is transferred to the Service Provider and cannot be cancelled, refunded, or appealed through the Platform.
9.3 Escrow Accounts
The Escrow Agent creates and maintains a special account for the User (the “Escrow Account”), which is used to hold and dispose of funds.
The parties authorise the Escrow Agent to act as their agent and, accordingly, to receive, hold, and transfer funds in accordance with these instructions.
Service Providers have access to the status of their Escrow Account through the Platform.
9.4 The Service Provider and the Escrow Agent
The Service Provider authorises the Escrow Agent to act on its behalf for the purpose of receiving, processing, and holding payments from Clients.
This authority includes receiving funds, temporarily placing them in the Escrow Account, and subsequently transferring them to the Service Provider in accordance with the instructions defined by this agreement.
The escrow system is designed to protect the interests of the parties by holding the Client's payments until the Work is approved. However, the escrow system does not guarantee the quality of the performed Work and/or does not exclude other risks.
9.5 Ownership of funds
Homecraft is not a banking institution.
Homecraft is obliged to ensure proper protection of the funds placed in Escrow Accounts and not to make them available to third parties without an appropriate basis.
Funds placed in Escrow Accounts are held, and payments made are processed, through licensed payment processors in accordance with their terms. These accounts are segregated from Homecraft's operating accounts.
9.6 No interest
The parties understand and agree that no interest or other financial benefit accrues on the funds placed in the Escrow Account and, accordingly, none is transferred to any party.
Homecraft, in accordance with these instructions, has the right to charge the parties commissions, receive a service fee, and/or other forms of remuneration.
9.7 Duties of the Escrow Agent
The Escrow Agent assumes only the obligations directly provided for by these instructions/this agreement.
The Escrow Agent: is not obliged to investigate the relationships, agreements, or communications existing between the Client and the Service Provider; is entitled to rely on the written notices, instructions, and requests provided by Users if it considers them authentic; is not obliged to verify the accuracy and/or content of such information; is not obliged to require or ensure the execution of payments, except where this is directly specified by the relevant instructions.
The Escrow Agent has the right to exercise its powers and obligations both directly and through third parties.
If the instructions provided by the parties contradict one another and/or the terms of the agreement, the Escrow Agent has the right to refrain from acting and to retain the funds in the Escrow Account until the parties reach an agreement or until a decision of the relevant competent authority.
9.8 Powers of the Escrow Agent
In the event of a dispute arising between the Client and the Service Provider, the Escrow Agent has the right, until the final decision related to the dispute, to suspend the disbursement of funds and to place them in an appropriate account/deposit at its discretion.
Homecraft receives a service commission, which is deducted from the payments to Service Providers before their transfer. The current commission rates are available on the Platform.
10. Refunds
The Client confirms and agrees that Homecraft is authorised to deduct funds from the payment methods specified by the Client.
A refund is possible: before approval of the Work/Milestone — on the basis of negotiation between the parties, although the Platform reserves the right to retain the service commission; after approval of the Work/Milestone — the payment is final and no refund will be made through the Platform.
The Client confirms and agrees that, except in the cases directly provided for by this agreement and by legislation, payments made by the Client are not subject to refund.
The Client is obliged not to initiate chargeback procedures with the bank or payment provider in respect of amounts paid for the service in accordance with the terms.
Homecraft reserves the right to cancel Orders in cases of fraud, breach of the terms, or other extraordinary circumstances.
11. Reviews
Only Users who have completed an Order may leave a review.
Reviews must be made in good faith and based on real experience.
Homecraft reserves the right to delete reviews that breach the terms of these instructions.
12. Dispute resolution
Homecraft's role in disputes arising between the Client and the Service Provider is strictly limited to providing information to the parties and, at its discretion, facilitating communication.
Homecraft is not an arbitrator, mediator, or judge and does not make decisions in relation to disputes between users.
13. Limitation of liability
Homecraft is not liable, and the User agrees that the Platform shall not be held liable for any damage or loss related to the terms of the service, including but not limited to the following:
viruses or other malicious software received as a result of accessing or using the Platform;
damage and/or malfunction of the User's device;
the acts or omissions of third parties (including Service Providers or Clients);
suspension, restriction, and/or termination of the User's account;
reliance on the accuracy, reliability, or completeness of the information posted on the Platform (including profiles, ratings, reviews, offers, and/or other data);
loss of the User's business and/or interruption of activity.
Homecraft is not liable for damage caused to the performer or to the performer of the service that arises from or is in any way connected with the services rendered or provided by Service Providers and/or the breach of an obligation on the part of the Client.
Homecraft's total liability shall not exceed the amount of the commissions you have paid to the Platform during the 12 months preceding the claim.
These limitations apply regardless of the legal basis of the claim (contract, tort, including negligence, or another basis).
14. Indemnification
The User agrees to fully indemnify Homecraft for any damage, liability, fine, and/or other costs (legal expenses) that arise, directly or indirectly, from or in connection with:
(a) the User's use of the Platform, including any act or omission carried out on the Platform;
(b) breach of these Terms of Service and/or of legislation;
(c) breach of the rights of any third party, including but not limited to intellectual-property, privacy, and/or other rights;
(d) services offered, received, or performed through the Platform, including disputes arising from the relationship between the Client and the Service Provider;
(e) the accuracy, legality, and/or compliance of any information, data, or content provided by the User or posted on the Platform;
(f) any agreement or transaction concluded by the User with third parties using the Platform;
(g) the use of the User's account by a third party, including cases related to unauthorised access.
Homecraft reserves the right, at its own discretion and at the User's expense, to defend its own claim or interests that are subject to indemnification under this clause. In such a case, the User is obliged to fully cooperate with Homecraft within the dispute.
The obligations provided for in this clause remain in force even after the User ceases to use the Platform.
15. Governing law
These terms are governed by and construed in accordance with the legislation of Georgia. Any legal proceedings shall be conducted in the courts of Tbilisi, Georgia. The Georgian version of these terms prevails in the event of a conflict with translations.
16. Changes to the terms
Homecraft reserves the right to change these terms at any time. Users will be notified of material changes by email or by a Platform notification. If you continue to use the Platform, this will be deemed agreement to the changed terms.
